CVS Gets California Physician’s Suit Over Opioid Refills Tossed

A California physician who said CVS Pharmacy Inc. stopped filling prescriptions for controlled substances for his patients must seek relief with the California State Board of Pharmacy, rather than the courts, a state appellate court said.

Kenneth S. Bradley said he specializes in pain treatment and management for patients who suffer chronic pain caused by conditions including cancer, surgeries, and degenerative diseases. He primarily serves patients from health maintenance organizations, which offer fixed-fee insurance.
