CVS Faces Trial on Improperly Distributed Prescription (1)

CVS Health Corp. is facing trial on claims an Ohio pharmacist negligently included an antidepressant meant for another customer with a batch of prescriptions issued to a patient.

Pamela Sue Mason’s complaint against the pharmacy was timely filed, the U.S. District Court for the Southern District of Ohio said May 3. It denied CVS’s motion for pretrial judgment.

A Newark, Ohio, CVS pharmacist filled several prescriptions for Mason July 24, 2015. They also filled a prescription for amitriptyline HCL, an antidepressant with sedative effects, for another customer. The amitriptyline was inadvertently distributed to Mason, along with her other medications.
