CVS Caremark Whistleblower Gets $95 Million Win in Drug Suit (1)

CVS Caremark Corp. owes the government $95 million for making misrepresentations about its prescription drug prices which caused Medicare to overpay subsidies in violation of the False Claims Act, a federal judge said.

Judge Mitchell S. Goldberg, of the US District Court for the Eastern District of Pennsylvania, made this determination in a Wednesday order after conducting a bench trial, which started March 10. The parties’ opening briefs on the trebling of the damages award and statutory penalties are due July 9, Goldberg said in a separate order.
