CVS Beats False Claims Action Against Its PBM Business

CVS Caremark Corp. scored a resounding victory against a whistle-blower’s False Claims Act lawsuit concerning CVS’s pharmacy benefit management business with Medicare Part D plan sponsors, when a federal district court in Pennsylvania granted CVS summary judgment on all claims (United States ex rel. Spay v. CVS Caremark Corp., 2015 BL 306342, E.D. Pa., 2:09-cv-04672-RB, 9/22/15).
