Covid-19 Hospital Care Suit Blocked by Federal Liability Shield

A hospital wasn’t liable for failing to obtain permission from a Covid-19 patient’s family before treating him with the antiviral medication remdesivir instead of ivermectin, the Nevada Supreme Court declared.

The federal Public Readiness and Emergency Preparedness Act barred the family’s medical negligence suit against the hospital for failing to obtain informed consent for the treatment, Nevada’s top court said Thursday in affirming the action’s dismissal.

The case presented the court with a question of first impression—whether the PREP Act barred a state-law informed consent claim.
