An Indiana professional licensing board lost its attempt to revoke the license of a pharmacist convicted of several drug-related crimes because it lacks the authority to revoke an expired license, a state appeals court said.
Agencies such as the Indiana Board of Pharmacy have only the powers granted to them by state lawmakers, the Indiana Court of Appeals said. Absent a grant of power and authority in the laws governing the board’s actions, that power doesn’t exist, it said.
Indiana laws governing professional licensing don’t give the board expansive authority to revoke an expired license, the court said.
