The federal government Jan. 25 dismissed False Claims Act allegations that Coloplast Corp. paid illegal kickbacks to medical supply companies following Coloplast’s settlement for almost $3.2 million with the government and three whistle-blowers (United States ex rel. Herman v. Coloplast Corp., D. Mass., 11-cv-12131-RWZ, voluntary dismissal 1/25/16).
Coloplast, a maker of ostomy and continence durable medical equipment, and five medical supply companies were accused by the whistle-blowers, two former employees and one current employee of Coloplast, of engaging in a kickback scheme to promote Coloplast’s DME products to patients, including beneficiaries of federal health-care programs.
