Cleveland Clinic Must Produce Doctor Motivation Documents

The Cleveland Clinic must give a medical malpractice plaintiff documents related to its alleged attempts to motivate doctors to increase neurology patient volume because the materials weren’t protected by Ohio’s peer review law, a state appeals court said.

Documents responsive to Eloise Hance’s discovery request consisted of emails from the head of Center for Spine Health to the center’s staff and staff meeting minutes. There was no proof the staff was a peer review committee or that the documents were produced for the purpose of improving patient safety, the Ohio Court of Appeals, Eighth District, said.
