The University of Cincinnati Medical Center and UC Health defeated a lawsuit alleging they’re vicariously liable for medical malpractice allegedly committed by four physicians granted credentials allowing them to treat patients at the facilities, a federal court in Ohio said.
A health-care provider may be held vicarious liability for a doctor’s negligence if there is an employer-employee relationship between the two. Ohio courts can also apply the doctrine of ostensible agency to hold a provider liable, the U.S. District Court for the Southern District of Ohio said.
