Cigna Fends Off Reconstructive Surgeons’ Surprise Billing Case

Cigna Health and Life Insurance Co. persuaded a federal court in New York to dismiss a surgery practice’s charges that it violated the No Surprises Act by not paying arbitration awards for breast reconstructive surgeries.

The US District Court for the Southern District of New York on Thursday also allowed Cigna’s some of its claims of fraud against East Coast Advanced Plastic Surgery, LLC to continue, saying the insurer demonstrated that ECAPS may have violated the Employee Retirement Income Security Act and New York state law.
