The US Chamber of Commerce and several state and local affiliates are suing the federal government claiming the drug price control provisions of the Inflation Reduction Act are unconstitutional and violate a host of federal laws, including those governing the separation of powers, due process, and the enumerated powers of Congress.
The lawsuit, filed Friday in US District Court for the Southern District of Ohio, seeks declaratory and injunctive relief from the defendants: the Department of Health and Human Services; the Centers for Medicare & Medicaid Services; HHS Secretary Xavier Becerra; and CMS Administrator Chiquita Brooks-LaSure.
