UnitedHealth Care was granted partial summary judgment in The Medical Society of the State of New York’s ERISA action claiming that United’s uniform refusal to pay facility fees contravened the terms of its health plans, a federal district court in New York ruled. A class of more than 200 physicians alleged that UnitedHealth refused to pay facility fees that out-of-network surgeons charge for office-based surgeries. The court ruled that the action can go forward on the injunctive relief claims, as well as several claims for wrongfully denied benefits under ERISA.
