Caremark, Express Scripts Appeal Hawaii Case’s State Court Shift

Two top companies managing prescription drug benefits in the US are fighting to keep Hawaii’s lawsuit against them in federal court after a judge ruled the case belonged in state court because it deals with issues specific to state health plans.

CVS Health Corp.'s Caremark and Cigna Group‘s Express Scripts separately filed notices of appeal Wednesday in the US District Court for the District of Hawaii, sending the case against the pharmacy benefits managers up to the US Court of Appeals for the Ninth Circuit.
