Californians’ Covid-19 Death Claim Returned to Los Angeles Court

A Los Angeles County assisted living facility must go back to state court to defend against claims asserted by an elderly resident’s family that its negligence caused the resident’s 2020 Covid-19 death, a federal court said.

The US District Court for the Central District of California on Wednesday rejected arguments by Olive Brown’s family that the federal Public Readiness and Emergency Preparedness Act mandated trying the case in federal court.
