California Nursing Home Death Suit Sent Back to State Court

A California nursing home must face a lawsuit over a resident’s Covid-19 death in state court because federal law didn’t supersede state law for purposes of the litigation, a federal court in state said.

Serrano Post Acute Care LLC improperly removed Emma Martin’s state-court complaint to federal court, the U.S. District Court for the Central District of California said Thursday.

Martin alleged the facility failed to take proper precautions to prevent the spread of coronavirus and failed to properly treat residents’ infections.
