California-Led Group Backs Provider in Arkansas Abortion Fight

A California-led group of states has joined an Arkansas abortion provider in urging the Eighth Circuit to continue blocking the state from enforcing laws banning abortions after 18 weeks’ gestation and those based on a fetal diagnosis of Down syndrome.

The laws are plainly unconstitutional, as they prohibit women from exercising their right to have an abortion before a fetus would be able to live outside the womb, the states said in a friend of the court brief filed in the U.S. Court of Appeals for the Eighth Circuit Jan. 7.
