Buyers of Abbott’s Recalled Baby Formula Cite Economic Harm

Parents who allege they overpaid for recalled Abbott Laboratories baby formula urged a federal court to allow their claims, saying they have standing to sue because they suffered economic injury from buying contaminated products.

The litigation followed recalls because of bacterial contamination at Abbott’s Sturgis, Mich., plant.

Consumers say they bought Abbott’s powdered infant formula based upon false and misleading claims that the products were safe to feed their children.

The economic loss suits were combined into a multidistrict proceeding before Judge Matthew F. Kennelly of the US District Court for the Northern District of Illinois. Some 26 lead plaintiffs ...
