A Bronx-Lebanon Hospital doctor injured during a 2017 mass shooting will get another chance to show that his remedy isn’t limited to workers’ compensation because the injury wasn’t related to workplace animosity, a state appeals court said.
New York’s Workers’ Compensation Board improperly found that Justin Timperio was injured during the course and scope of his employment, because he and the shooter didn’t know each other, and there was no evidence they had work-related differences, the New York Supreme Court Appellate Division, Third Department, said.
