Bristol Hits Medicare With Fresh Suit Over Price Negotiations

Bristol-Myers Squibb Co. is stepping into the fight to block Medicare’s new authority to negotiate the prices of certain drugs, filing its own federal lawsuit against the federal government Friday.

The New York-based company, whose anticoagulant medication Eliquis is among those likely to face Medicare-negotiated prices in the coming years, filed its lawsuit in US District Court for the District of New Jersey against the Department of Health and Human Services and the Centers for Medicare & Medicaid Services. HHS Secretary Xavier Becerra and CMS Administrator Chiquita Brooks-LaSure are also defendants in the case.
