Breastfeeding consultants who don’t qualify for licenses under a George law are entitled to a new trial in their state constitutional challenge to the provision, the state’s top court said Monday.
The Georgia Constitution recognizes a substantive due process right to work in one’s chosen profession, and a state trial court erred in concluding otherwise, the Georgia Supreme Court said.
The court also reinstated the consultants’ claim that the Georgia Lactation Consultant Practice Act violates their state constitutional equal protection rights because it treats lactation consultants who have certain credentials differently than others.
