Boston Scientific Must Turn Over Fraud Investigation Materials

Boston Scientific Corp. can be compelled in discovery to disclose material it provided to the U.S. government during a fraud investigation, the District of Minnesota said.

Neither a federal evidence rule nor the False Claims Act protects the materials from disclosure to a man prosecuting fraud claims on the government’s behalf, the U.S. District Court for the District of Minnesota said.

Whistleblower Steven Higgins sued the device maker for violating the False Claims Act. BSC caused physicians to make false claims for Medicare and Medicaid payments for defective implantable cardiac defibrillators, he said.
