Blue Cross Fraud Claim to Proceed Against Infusion Provider

A home infusion services provider will have to defend against Blue Cross Blue Shield of Michigan’s claims that it billed for services that it didn’t actually perform, a federal court in Michigan said.

The insurer stated a claim that Advanced Infusion Solutions violated Michigan’s Health Care False Claims Act because it alleged conduct that went beyond the “mere breach” of the parties’ contract, such as the provider’s certification that the services were actually provided when it knew that they hadn’t been, the US District Court for the Eastern District of Michigan said March 29.
