A transgender teenager can proceed with an Affordable Care Act lawsuit alleging his health insurer discriminated against him by denying coverage for gender dysphoria treatment, a federal court said.
C.P. stated a claim for sex discrimination under Title IX, and by extension the Affordable Care Act’s Section 1557, by plausibly alleging that Blue Cross Blue Shield of Illinois is a healthcare program that receives federal financial assistance and that he was excluded from coverage for health-care services on the basis of sex, the U.S. District Court for the Western District of Washington said.
