The Fifth Circuit is being called on to decide on the validity of an HHS guidance reminding hospitals that they may have to provide abortions under a federal emergency care law, regardless of whether the procedure is lawful in the state where they’re located.
The Biden administration has filed a notice of appeal from an August order that blocked the US Health and Human Services Department from enforcing a guidance that reminds hospitals that participate in federal health-care programs that their obligations under the Emergency Medical Treatment and Labor Act may require them to perform abortions in some circumstances.
