Black Hospital Visitor’s Race Bias Suit Revived by Appeals Court

A Black woman can proceed with a claim that a Wisconsin hospital discriminated against her based on her race when it barred her from visiting her mother while a patient there, an appeals court said.

Shawanda Collins adequately alleged that Aurora St. Luke’s Medical Center violated Title VI of the Civil Rights Act of 1964 when it barred her from the premises after characterizing her as “an angry black female,” the US Court of Appeals for the Seventh Circuit said Tuesday. Collins wasn’t required to plead race discrimination with specificity or particularity, the court said in the unpublished opinion.
