The Biden administration asked a federal court Wednesday to dismiss an amended lawsuit by a Medicare managed care plan that seeks redress for health agency actions that allegedly harmed the insurer’s reputation and competitive position.
The federal government’s motion claims the amended lawsuit, filed by Zing Health Inc. in the US District Court for the District of Columbia in July, lacks subject-matter jurisdiction “under Federal Rule of Civil Procedure” and its requests for relief are either moot or prohibited by law.
