The Food and Drug Administration would be permitted to destroy imported counterfeit medical devices under H.R. 5663, an expansion of its authority over counterfeit drugs that are refused admission into the U.S.

The bill would apply to imported devices, such as masks and diagnostic tests, that have or are in packaging that has an unauthorized trademark, trade name, or other identifying mark, imprint, or symbol that belongs to a different manufacturer, packer, or distributor.
