BGOV Bill Summary: H.R. 26, Abortion Survivor Medical Care

Health-care practitioners would have to provide medical care to a child who survives an abortion or attempted abortion procedure equivalent to the care received by a newborn delivered at the same gestational age under H.R. 26.

Medical personnel who don’t comply could be criminally charged and subject to civil liability.

The measure’s findings would state that an infant who survives an abortion “is a legal person for all purposes” of US law and has “the same claim to the protection of the law” as any newborn or individual seeking treatment at a hospital, clinic, or other facility.
