BGOV Bill Analysis: S. J. Res. 84, ACA Marketplace Rule Repeal

A Centers for Medicare and Medicaid Services rule that tightened oversight of Affordable Care Act health insurance exchanges would be repealed using the Congressional Review Act under S. J. Res. 84.

The rule — which CMS projected would reduce enrollment by up to 1.8 million in 2026 — imposed a $5 fee on certain low-income auto-enrollees; shortened enrollment periods on ACA exchanges; and allowed insurers greater leeway in lowering the actuarial value of their plans, which refers to the share of medical costs the insurer pays.
