BGOV Bill Analysis: H.R. 3492, Criminalize Gender-Affirming Care

Health-care providers who perform gender-affirming surgeries or provide hormone therapy to minors could be fined and imprisoned for 10 years under H.R. 3492.

The bill’s supporters say federal criminalization is necessary amid a patchwork of state laws that allow minors to receive gender-affirming care, such as in California and Washington.

Republicans cited a 2025 Health and Human Services Department report faulting medical organizations’ “problematic” guidance on gender-affirming treatments, in the House Judiciary Committee report on the bill. They also argued Supreme Court precedent “protects a parent’s fundamental right” to make decisions on behalf of their children.
