BCBS Defeats Federal Workers’ Experimental Cancer Coverage Suit

Blue Cross & Blue Shield Association won a federal worker’s proposed class action over the denial of coverage for an experimental cancer treatment after the Northern District of Texas found the claims preempted by federal law.

The Federal Employees Health Benefits Act of 1959—the law that authorizes the Office of Personnel Management to contract with private carriers like BCBS to offer federal employees an array of health-care plans—precludes the state law claims, the court said.
