C.R. Bard Inc. and Davol Inc. kept their win in the first test case over their hernia mesh, as a federal court in Ohio rejected a Utah man’s arguments that violations of evidentiary orders entitled him to a new trial.

Steven Johns alleged Ventralight ST mesh products used in two hernia repair procedures caused abdominal adhesions—a type of scar tissue—that left him with chronic pain.

A jury in the U.S. District Court for the Southern District of Ohio rejected his product liability claims in September.
