Bank of America Beats Suit Over International Debit Card Fees

Bank of American NA escaped a proposed class action by customers alleging that their debit-card agreements didn’t allow the fees they were charged when they used the cards abroad, a federal appeals court affirmed.

The breach of contract claims by Carlos Alfaro and Henrietta I. Egbunike were properly dismissed, Judge Robert J. Luck said Thursday in an unpublished opinion. The series of agreements governing the cards didn’t establish that BoA wouldn’t charge the fees, Luck said for the US Court of Appeals for the Eleventh Circuit.
