Arkansas Wants Supreme Court Review of Drug Pricing Law

An Arkansas law regulating how companies like Express Scripts and CVS Health reimburse pharmacies for prescription drugs is valid and doesn’t interfere with federal employee benefits law, the state told the U.S. Supreme Court.

Arkansas on Oct. 22 asked the justices to overturn a federal appeals court’s 2018 decision striking down the state’s drug pricing law as preempted by the Employee Retirement Income Security Act.
