Arkansas Rejects Call for High Court Review of Drug Discount Law

An Eighth Circuit decision upholding an Arkansas law that prohibits drugmakers from imposing conditions on contract pharmacies under a federal drug discount program doesn’t need Supreme Court intervention, the state told the justices Monday.

The Arkansas Insurance Department and intervenors Community Health Centers of Arkansas and Piggott Community Hospital urged the US Supreme Court in opposition briefs to deny a petition to review whether the US Court of Appeals for the Eighth Circuit was right when it ruled the state’s Act 1103 isn’t preempted by the federal 340B statute.
