Arkansas Abortion Laws Remain Blocked After 8th Circuit Ruling

Arkansas laws banning abortions when a fetus reaches 18 weeks’ gestational age and when a women’s reason for the procedure is a prenatal diagnosis of Down syndrome are unconstitutional and can’t be enforced, the Eighth Circuit said Tuesday.

Little Rock Family Planning Services and physician Thomas Tvedten are likely to win their argument that the laws violate a woman’s constitutional right to end a pregnancy before a fetus would be able to live outside the womb because both apply to previability procedures, the U.S. Court of Appeals for the Eighth Circuit said.
