A hospital in Arizona must answer claims it negligently hired, credentialed, and supervised a doctor even after the doctor settled malpractice claims against him.
The Arizona Supreme Court July 9 clarified that bariatric surgery patients Thomas Kopp, Melissa Ornelas, and Maria Judith Gonzalez still would have to prove Dr. Eric Schlesinger’s negligence at trial on their claims against St. Luke’s Medical Center. St. Luke’s potential liability, however, didn’t arise from the doctor’s wrongdoing.
