Arizona Abortion Providers Push to Revive Reason Ban Lawsuit

Physicians who perform abortions in Arizona asked a federal appeals court to overturn a ruling that they lack standing to challenge the state’s ban on procedures related to “genetic abnormalities.”

The vague nature of the ban exposes physicians to a severe threat of arbitrary prosecution that could result in criminal, civil, and licensure penalties, the doctors said in a brief filed in the US Court of Appeals for the Ninth Circuit Friday.

These imminent future injuries satisfy standing requirements for the pre-enforcement challenge and demonstrate that the doctors have “a personal stake in the outcome of the controversy,” they said. ...
