Arab Muslim Doctor Loses Bias Claim Against Kansas Hospital

A Kansas hospital properly won summary judgment in an employment discrimination lawsuit brought by an Arab Muslim doctor because he wasn’t its employee, the Tenth Circuit said.

Title VII prohibits employers from discharging or discriminating against employees based on race, religion, national origin, and other characteristics. An employer-employee relationship is essential to state a claim under the law, the U.S. Court of Appeals for the Tenth Circuit said.

Rafik Benaissa is a board-certified orthopedic surgeon who provided temporary services at Salina Regional Health Center under the hospital’s contract with LocumTenens.com. He sued the hospital for discrimination after the relationship ended. ...
