The Minnesota government remains barred from enforcing its law prohibiting certain price hikes on generic drugs after a federal appeals court on Thursday upheld a lower court’s preliminary injunction on the state statute.
A three-judge panel of the US Court of Appeals for the Eighth Circuit said the Association for Accessible Medicines, which represents generic and biosimilar manufacturers, showed it’s likely to succeed on its claim that the Minnesota law violates the dormant commerce clause of the US Constitution by regulating transactions that take place “wholly outside of Minnesota.”
