Anti-Abortion Texan Fails to Shut Down Six-Week Ban Challenge

A Texas group that helps people legally obtain abortions in other states can proceed with its suit against a woman who threatened to sue the group for violating a Texas law banning abortions there after about six weeks.

The Texas Citizens Participation Act didn’t bar the Lilith Fund for Reproductive Equity lawsuit because it wasn’t based on, or in response to, defendant Sadie Weldon’s exercise of her free speech, petition, or association rights, the Texas Court of Appeals, Second District, said Thursday. The fund sought a declaratory judgment that Texas’ 2021 anti-abortion law was unconstitutional.
