Two North Carolina localities will face a suit by anti-abortion protesters over a Covid-19 stay-at-home order because the protesters properly alleged the provision violated their religious free exercise rights, a federal court in the state said.
The protesters’ suit against Charlotte and Mecklenburg County isn’t moot, even though the order and its restriction on gathering sizes has expired, because it seeks nominal damages for the alleged past constitutional deprivation, the U.S. District Court for the Western District of North Carolina said.
