Amgen Sues HHS Over Low-Income Drug Discount Program

Amgen Inc. is the latest pharmaceutical giant to sue the Department of Health and Human Services, challenging how the department administers a federal drug discount program that serves low-income Americans.

HHS’s determination that Amgen is violating the law by failing to extend certain discounts to pharmacies is arbitrary, capricious and contrary to the law, the company alleged in a lawsuit filed Monday in the US District Court for the District of Columbia.

The government’s 340B program requires drugmakers to offer cheaper drugs to hospitals, community health centers, and other providers that service low-income people.
