Allnurses.com Inc. held on to a win in a lawsuit over allegedly defamatory comments published on its discussion forum because federal law immunized it from liability arising out of content created by others, the Eighth Circuit said Wednesday.
East Coast Test Prep LLC didn’t allege facts sufficient to attribute statements that it was being investigated by the federal government to Allnurses.com, the U.S. Court of Appeals for the Eighth Circuit said.
Section 230 of the Communications Decency Act thus got the website off the hook for comments made by users of its online forum, the court said.
