Allergan Inc. will pay $3.5 million to settle allegations that the way it marketed its LAP-BAND Adjustable Gastric Banding System caused health-care providers to submit false claims to Medicare.
The settlement between the Parsippany, N.J.-based unit of Irish pharmaceutical giant Allergan plc, the U.S. Department of Justice, and whistle-blowers Dr. Monte Schwartz and Ryan Tinsley was announced April 16 by the U.S. Attorney’s Office for the District of Maryland.
The settlement resolves allegations that between January 2008 and November 2010, the company sold LAP-BANDs it knew were flawed or defective, then attempted to cover up the facts, the settlement says. ...
