Alleged Rape Victim Gets New Chance at Suit Against Hospital

A South Carolina hospital is facing a renewed accusation that its staff negligently mishandled a rape kit after a state appeals court found that a trial judge improperly dismissed the claim.

Plaintiff Jane Doe should have been allowed to amend her complaint before dismissal, the South Carolina Court of Appeals said. There was no evidence that an amendment would have been futile, the court said.
