AI Class Action Against Humana Gets Federal Judge’s Go-Ahead

A federal court will allow Humana Medicare Advantage members to proceed with their class action alleging the company improperly used artificial intelligence to make coverage decisions.

Friday’s decision by Judge Rebecca Grady Jennings of the US District Court for the Western District of Kentucky allows the affected class members to proceed with their claims that Humana engaged in fraud, unjust enrichment, breach of contract, and breach of good faith and fair dealing when it failed to disclose to beneficiaries that it had used AI software to make coverage determinations.
