Rosalie Vaccarino sued Aetna in California state court, alleging her Aetna health management plan wrongfully refused to pay for the treatments.
A four-month delay in treatment resulting from the denial allowed cancerous tissue to grow back, causing irreversible injury, Vaccarino said.
