Acadia Set to Face Trial in Investor Class Suit Over Quality (1)

Acadia Healthcare Co. Inc. lost its bid avert trial in an investor class action alleging the behavioral health-care provider misrepresented its patient care, staffing, and regulatory compliance.

Chief Judge William L. Campbell Jr. also granted the investors’ request for presumptions of class-wide reliance on any omissions or misstatements they show to be pertinent to investment decisions at trial. Acadia failed to identify any evidence to rebut a presumption tied to withheld information and didn’t sufficiently refute the assumption connected to alleged misrepresentations, the US District Court for the the Middle District of Tennessee said Thursday.
