Abortion Providers Call Mifepristone Regulation Unconstitutional

A group of abortion providers in Virginia, Montana, and Kansas filed suit in federal court Monday demanding that the Food and Drug Administration do away with administrative restrictions on an abortion pill, as other courts consider cases that could affect its availability.

Mifepristone is subject to a Risk Evaluation and Mitigation Strategy (REMS) typically reserved for “drugs with serious side effects such as death, incapacity, or birth defects,” which medical providers like Whole Woman’s Health and Blue Mountain Clinic say does not describe the abortion pill.
